Where is mushroom cultivation legal in the U.S.?
Research continues to demonstrate the value of psilocybin in treating mental health conditions. However, as with the early days of medical cannabis, the legal landscape in the U.S. is still catching up. This creates challenges for entrepreneurs, service centers, growers, and anyone else wanting to enter the fledgling psychedelics industry.
Here is an overview of where psychedelics are legal in the U.S.—or, at least, decriminalized.
Oregon
Oregon became the first state to legalize the supervised use of psilocybin for therapeutic purposes in 2020, paving the way for licensed manufacturers to cultivate psilocybin mushrooms for use in controlled, supervised settings. Find out more about how to get a cultivation license here.
Oregon began accepting applications for Psilocybin Manufacturer licenses on January 2, 2023, allowing licensed businesses to cultivate, process, and package psilocybin mushrooms for use in supervised therapeutic settings. To date, 11 manufacturing facilities have been licensed as well as 30 service centers, 347 facilitators, one testing lab, and 22 training programs.
Colorado
In 2022, Colorado decriminalized the personal use, possession, and cultivation of psilocybin mushrooms for adults over 21. The legal frameworks to regulate the supervised medical use of mushrooms in Colorado are still being developed but Colorado’s psychedelics regulation bill (SB 290) became law in May 2023.
The rollout for licensing the cultivation of mushrooms is planned for 2025 and, by 2026, the Colorado natural medicine program could expand to include other natural psychedelics, including dimethyltryptamine (DMT), ibogaine, and mescaline.
New Mexico
In New Mexico, personal cultivation has effectively been decriminalized but intent to distribute remains illegal, so “manufacturing” or growing mushrooms to sell is prohibited.
Outside of the state laws, several cities have decriminalized the possession and use of psilocybin mushrooms—including Seattle (Washington), Oakland and Santa Cruz (California), and Washington D.C.—but laws on mushroom cultivation vary.
Also, keep in mind that despite the Food and Drug Administration (FDA) recognizing psilocybin’s potential as a treatment for depression, it remains a Schedule I controlled substance at the federal level. The illegal cultivation of psilocybin carries the risk of a lengthy prison sentence if convicted.
Where are cultivation licenses available?
While other states are considering legislation for the therapeutic use of psilocybin, mushroom cultivation licenses are currently only available in Oregon from the Oregon Health Authority (OHA). Manufacturing licenses will soon be available in Colorado from the Natural Medicine Division.
The U.S. Drug Enforcement Administration (DEA) issues licenses for the cultivation of psilocybin mushrooms for research purposes but licenses are usually reserved for research institutions that adhere to stringent regulations.

- Proof of residency: most applicants must show that they have been residents of the state for at least two years.
- A detailed map or sketch of the proposed premises.
- Location requirements: the business cannot be located on publicly owned land or overlap with any other licensed areas for certain types of businesses.
- A criminal background check—although old convictions for manufacturing psilocybin or marijuana or possession of a controlled substance may be disregarded.
Further documentation may be requested from the licensing authority and an inspection of the proposed business premises may be conducted before a license is issued.
